காதல் திருமணம் செய்து தம்மை ஏமாற்றிய ஓய்வுபெற்ற சப் – இன்ஸ்பெக்டர் மீது 36 ஆண்டு சட்டப்போராட்டம் மூலம் டி.என்.ஏ டெஸ்ட் எடுத்து பெண் ஒருவர் வழக்குப் பதியவைத்த சம்பவம் சென்னையில் நடந்திருக்கிறது.
சென்னை கொளத்தூர் முருகன் நகரைச் சேர்ந்த இளவரசி (65), 19 வயதில் அதே பகுதியைச் சேர்ந்த விஜய கோபாலன் என்பவர் மீது காதல் ஏற்பட்டிருக்கிறது. 1975-ல் குடும்பத்தினர் எதிர்ப்பை மீறி இருவரும் திருமணம் செய்திருக்கிறார்கள். குடும்பத்தினர் சம்மதிக்காததால், பெங்களூர் சென்று சில மாதங்கள் வாழ்ந்த அவர்கள் சென்னை திரும்பி பல இடங்களில் குடும்பமாக வசித்திருக்கிறார்கள். சுமார் 7 மாதங்கள் இருவரும் ஒன்றாக வாழ்ந்த நிலையில், இளவரசி கர்ப்பமடைந்திருக்கிறார்.
அதன்பிறகு வேலை விஷயமாக ஹைதராபாத் சென்ற விஜய கோபாலன், தன்னை வேறொரு திருமணம் செய்து கொள்ளுமாறு கூறிவிட்டு சென்றதாக இளவரசி கூறுகிறார். இதனால், முருகன் நகர் பகுதியிலேயே வேறொரு வீட்டில் ரகசியமாக தனது தாய் தன்னை வைத்து பார்த்து கொண்டதாகவும், அந்த ஆண்டே பெண் குழந்தை பிறந்ததாகவும் சொல்கிறார்கள். கணவர் குறித்து 1975-ம் ஆண்டு குழந்தை பிறந்த இரண்டாவது நாளிலேயே சென்னையில் உள்ள காவல் நிலையத்தில் புகார் அளித்ததாகவும், இரு வீட்டாரின் பெற்றோர்களையும் அழைத்து காவல் நிலையத்தில் பேச்சுவார்த்தை நடந்ததாகவும், பிறகு தான் வசித்து வந்த ஜி.கே.எம் காலனி ஊர்த் தலைவரிடம் முறையிட்டதாகவும் இளவரசி கூறியுள்ளார்.
இதுகுறித்து இளவரசி மேலும் கூறுகையில், “விஜய கோபாலன் வரும்வரை என்னையும், எனது குழந்தையையும் பார்த்துக் கொள்ள வேண்டும் என விஜய கோபாலன் பெற்றோர்களிடம் ஊர் மக்கள் மத்தியில் கையெழுத்து வாங்கப்பட்டது. அன்று இரவோடு இரவாக ஊர் மக்கள் மத்தியில் கையெழுத்திட்ட ஆவணங்கள் அனைத்தையும் விஜய கோபாலனின் பெற்றோர்கள் ஏமாற்றி வாங்கிச் சென்று விட்டார்கள். அதன் பின் வாழ்வாதாரத்திற்காகப் போராட ஆரம்பித்தேன். 1982-ல் திருத்தணி பள்ளிப்பட்டு கிராமத்தில் சத்துணவு ஊழியராக வேலை கிடைத்து, பார்க்க ஆரம்பித்ததேன்.1985-ல் விஜய கோபாலன் இரண்டாவது திருமணம் மேற்கொள்ள இருந்தபோது, மீண்டும் காவல்துறையை அணுகி பல்வேறு முறை புகார் அளித்தும் நடவடிக்கை எடுக்கப்படவில்லை.
விஜய கோபாலன் காவல்துறையில் சேர்ந்ததால் அவர் மீது நடவடிக்கை எடுக்காமல் போலீசார் மறுத்தனர். இதற்கிடையில் எனது மகள் தேவியை, சகோதரர் எடுத்து வளர்த்து திருமணம் செய்து வைத்தார். மகள் தேவியின் கணவர் துபாயில் விபத்தொன்றில் இறந்துவிட்டதால் அவர் சென்னை வந்து என்னுடன் சேர்ந்து இருந்து வருகிறார். எனது மகளின் தந்தை விஜய கோபாலன்தான் என நிரூபிப்பதற்காக நானும், என் மகள் தேவியும் முயற்சிகள் செய்து தோல்வியடைந்தோம்.
இருந்தாலும், என் மகள் தேவி தனக்கென்று ஒரு அடையாளம் வேண்டும் என்று சட்டப் போராட்டத்தில் இறங்கியதன் அடிப்படையில், 2010-ல் நீதிமன்றத்தில் வழக்கு தொடர்ந்தோம். நீதிமன்றத்தில் வழக்கு வந்தவுடன் காவல் துறையில் பணிபுரிந்து உதவி ஆய்வாளராக ஓய்வு பெறும் நிலையில், நானும் என் மகளும் பணத்திற்காக திட்டமிட்டு செயல்படுவதாகவும் விஜய கோபாலன் நீதிமன்றத்தில் பதில் மனு தாக்கல் செய்தார்.
நீதிமன்றத்தில் வழக்கு உள்ளபோதும் தொடர்ந்து 17 மனுக்கள் சென்னை காவல்துறை உயர் அதிகாரிகள் முதல் கீழ்நிலை அதிகாரிகள் வரை புகார் அளித்தும் எந்தவித நடவடிக்கையும் எடுக்கப்படவில்லை. எனது புகாரில் வழக்குப் பதிவு செய்யாமல் நீதிமன்றத்திலேயே பார்த்துக் கொள்கிறேன் எனவும், வழக்குப் பதிவு வேண்டாம் எனவும் காவல்துறையில் வலுக்கட்டாயமாக என்னிடம் எழுதி வாங்கிக் கொண்டனர். இதனிடையே நீதிமன்ற உத்தரவின் அடிப்படையில் 2015-ம் ஆண்டு டி.என்.ஏ பரிசோதனையில் விஜய கோபாலன், தனது மகளுக்கு தந்தை என்பது உறுதியானது.
நீதிமன்றம் மூலம் டி.என்.ஏ பரிசோதனை எடுத்து உத்தரவு பெற்ற பிறகும், விஜய கோபாலன் ஓய்வு பெறும் போது பணியாளர் பதிவேட்டில் என்னை மனைவி என்றும், தேவிதான் முதல் வாரிசு என தெரிவிக்கவும் விஜய கோபாலன் தொடர்ந்து மறுத்து வந்தார். நீண்டகால சட்டப் போராட்டத்திற்கு பிறகு 2020-ல் விஜய கோபாலனுக்கு எதிராக மகளிர் நீதிமன்றத்தில் தீர்ப்பு வழங்கப்பட்டது. `இளவரசியின் கணவர் விஜய கோபாலன் தான் என்றும் அவரது வாரிசு தேவி’ என்றும் நீதிமன்றம் உத்தரவு பிறப்பித்தது. மேலும் விஜய கோபாலன் மீது சட்டப்பூர்வமாக நடவடிக்கை எடுக்கவும் நீதிமன்றம் உத்தரவிட்டது’’ என்று தெரிவித்தார்.
இந்தநிலையில் இளவரசி, தலைமைச்செயலக காலனி காவல் நிலையத்தில் உள்ள அயனாவரம் அனைத்து மகளிர் போலீசாரிடம் மீண்டும் புகார் கொடுத்தார். அதன்பேரில் போலீசார், மனைவி, குழந்தையை பரிதவிக்கவிட்ட 72 வயதான ஓய்வுபெற்ற உதவி ஆய்வாளர் விஜயகோபாலன் மீது வழக்கு பதிவு செய்தனர்.
சுமார் 45 வருடங்களுக்கு மேலாக தனது மகளுடன் பரிதவித்து வந்த இளவரசி, சுமார் 36 வருட சட்டப்போராட்டத்துக்கு பிறகு விஜயகோபாலன்தான் தனது கணவர் எனவும், அவர் மூலம் தனக்கு பெண் குழந்தை பிறந்தது என்பதையும் நிரூபித்திருக்கிறார். தன்னை ஏமாற்றிய ஓய்வுபெற்ற சப்-இன்ஸ்பெக்டரான தனது கணவர் மீது வழக்குப்பதிவு செய்ய வைத்ததன் மூலம் பல வருட போராட்டத்திற்கு தீர்வு கிடைத்ததாக இளவரசி தெரிவித்துள்ளார்.
இதுகுறித்து பேசிய இளவரசியின் மகள் தேவி, “நானும் எனது தாயையும் பணத்திற்காக மோசடி செய்யவில்லை. விஜயகோபாலன்தான் என் தந்தை என உலகத்துக்கு நிரூபிக்கவே சட்டபோராட்டம் நடத்தினோம்’’ என்றார். திருமணம் செய்துகொண்டு ஏமாற்றிய கணவர் மீது புகார் அளித்தும் காவல்துறையிலும், நீதித் துறையிலும் 45 வருட போராட்டத்தில் கிடைத்த தாமதப்படுத்தபட்ட நீதியே தங்களுக்கு கிடைத்த ஆறுதல் என இளவரசி தெரிவித்துள்ளார்.
