வன்னியர்களுக்கு 10.5% உள் ஒதுக்கீடு
தமிழகத்தில் கல்வி மற்றும் வேலைவாய்ப்பில் மிகவும் பிற்படுத்தப்பட்டோருக்கு 20% இட ஒதுக்கீடு நடைமுறையில் இருக்கிறது. இந்த இட ஒதுக்கீட்டில் உள் ஒதுக்கீடாக வன்னியர் சமுதாய மக்களுக்கு 10.5% வழங்க தமிழக அரசு கடந்த பிப்ரவரி 26-ல் சட்ட முன்வடிவைக் கொண்டுவந்தது. முந்தைய அ.தி.மு.க ஆட்சியின்போது சட்டப்பேரவையில் நிறைவேற்றப்பட்டது. தி.மு.க ஆட்சிக்கு வந்த பிறகு இந்த சட்டத்துக்கு அரசாணையும் வெளியிடப்பட்டது. இந்தநிலையில், வன்னியர்களுக்கான 10.5% உள் ஒதுக்கீட்டு சட்டத்தை ரத்து செய்யக் கோரி பல்வேறு தரப்பினரும் சென்னை உயர் நீதிமன்றத்தில் வழக்குத் தொடர்ந்தனர்.
உயர் நீதிமன்றம் தீர்ப்பு
இந்த வழக்கு உயர் நீதிமன்ற நீதிபதிகள் எம்.துரைசாமி, கே.முரளிசங்கர் ஆகியோர் அடங்கிய அமர்வு முன்பாக விசாரிக்கப்பட்டு வந்தது. சிறப்பு வழக்காக எடுத்துக் கொள்ளப்பட்டு தினசரி இந்த வழக்கின் விசாரணை நடந்து வந்தது. உள் ஒதுக்கீடை ரத்து செய்ய வேண்டும் என 50-க்கும் மேற்பட்ட மனுதாரர்கள் நீதிமன்றத்தில் ஆஜராகி வாதிட்டனர். இட ஒதுக்கீட்டுக்கு ஆதரவாக பா.ம.க-வைச் சேர்ந்த வழக்கறிஞர் பாலு வாதிட்டு வந்தார். அரசு தரப்பில் இட ஒதுக்கீட்டை ரத்து செய்யக் கூடாது என்று வாதிடப்பட்டது. இட ஒதுக்கீட்டுக்கு எதிராக வாதிட்டவர்கள் தரப்பில், சாதிவாரி கணக்கெடுப்பு நடத்தப்பட்டு முடிக்காமல் எப்படி இட ஒதுக்கீடு வழங்க முடியும். எம்பிசி எனப்படும் மிகவும் பிற்படுத்தப்பட்டோருக்கான 20% இட ஒதுக்கீட்டில் 68 சாதிகள் கொண்ட சீர்மரபினருக்கு 7.5% உள் ஒதுக்கீடு வழங்கப்பட்டுள்ளது. இந்தநிலையில், வன்னியர்களுக்கு 10.5% உள் ஒதுக்கீடு வழங்கப்பட்டால், எம்பிசி-யில் உள்ள 22 சாதியினருக்கு வெறும் 2.5% உள் ஒதுக்கீடு மட்டுமே கிடைக்கும். எனவே, எம்பிசி பிரிவில் வன்னியர்களுக்கு 10.5% உள் ஒதுக்கிடு வழங்கும் சட்டம் செல்லாது என அறிவிக்க வேண்டும் என்று வாதிடப்பட்டது. இந்த சட்டத்தை எதிர்த்து உயர் நீதிமன்றத்தில் 25 வழக்குகள் நிலுவையில் இருந்தன.
